Terms of Use · Whatever

These terms are the agreement between you and Northbound Digital, a trading name of José Pedro Almeida Brás, Coimbra, Portugal ("we") for the Whatever app. By creating an account you accept them. If you do not agree, do not use the app.

The service

Whatever helps two people decide what to have for dinner: each one votes in secret, both swipe the same deck of dishes and restaurants, and the first one you both like is dinner (or a roulette picks among the closest). It also keeps your dinner history and favourite places, and with Premium reads restaurant menus and more.

Who can use it

You must be at least 16 years old and able to make a binding agreement. One person, one account. Keep your sign-in to yourself; you are responsible for what happens in your account.

You and your partner

When you link with someone, that person sees your name, your swipe progress, the dinners you decide together and the photos added to them, and can add photos and places that you will see too. Only link with someone you know. You can unlink at any time in Settings; your partner keeps the shared history.

Food, allergies and suggestions: please read

Dish and restaurant suggestions are ideas, not advice. Allergen and diet information in the app comes from our catalogue, from OpenStreetMap and from AI reading of menus, and it can be incomplete or wrong. If you have an allergy or a dietary need, always confirm with the restaurant or check the ingredients yourself. Restaurant details (opening hours, location, photos, ratings) come from third parties and may be out of date.

Acceptable use

Do not: use the app against the law; upload photos you have no right to share or that are illegal, sexual, violent or hateful; try to access other people's data or accounts; probe, overload or reverse engineer our servers beyond what the law allows; use bots or automated access; resell the service. We may suspend or close accounts that break these rules, after telling you why when we can.

Your content

Photos and places you add remain yours. You give us the permission we need to store them and show them to you and your partner, only to run the app. When you delete them or your account, that permission ends (shared dinners stay visible to your partner as explained in the Privacy Policy).

Premium, free trial and payment

Premium is a subscription bought through the App Store or Google Play. The price, the period and any free trial are shown before you confirm. One subscription covers both people in the couple.
Free trial: when offered, it lasts 14 days. We remind you before it ends. If you do not cancel at least 24 hours before the end of the trial, the subscription starts and the store charges you.
Renewal: the subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in your App Store or Google Play account settings. Deleting the app or your account does not cancel it.
Refunds are handled by Apple or Google under their rules. Nothing here limits your rights as a consumer.
Premium follows the person who pays. If the paying partner leaves the couple or deletes the account, the couple loses Premium.
EU and UK consumers: you have the right to withdraw from a purchase within 14 days. By starting Premium straight away you ask us to begin immediately and acknowledge that, once the service has been fully provided, the right of withdrawal ends; during the free trial you can cancel at no cost.
We may change prices for future periods; the store will tell you before a new price applies and you can cancel.

Third-party services

The app opens delivery apps, maps, web searches and other services, and uses data from OpenStreetMap, Google and Wikimedia Commons. Those services have their own terms, and we are not responsible for them or for orders you place with them.

Availability and changes

We work to keep Whatever running and safe but we cannot promise it will always be available or free of errors. We may change or stop features; if we stop the whole service we will tell you in advance and, for paid periods not used, the store refund rules apply.

Liability

We provide the app with reasonable care. To the extent the law allows, we are not liable for indirect or unforeseeable losses, or for losses caused by third-party services or by the inaccuracy of suggestions and allergen information described above. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any liability that cannot be limited by law, including your statutory rights as a consumer.

Ending

You can stop using Whatever and delete your account at any time in Settings. We may end these terms if you seriously or repeatedly break them.

Law and disputes

These terms are governed by the laws of Portugal, without taking away the protection given to you by the mandatory laws of the country where you live. If you are a consumer in the EU you may bring a claim in the courts of your country. Consumers in Portugal can also use an alternative dispute resolution entity (list at www.consumidor.gov.pt). Before any of that, please write to whateverapp.help@gmail.com: most things get solved there.

Apple App Store

If you got the app from the App Store: these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims about the app (including product liability, legal compliance or intellectual property claims). If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation. You confirm that you are not in a country subject to a US Government embargo or on any US Government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
